Williams Preferred Owner Program Terms & Conditions

The following are the terms and conditions of which you are offered the use of a Williams Preferred Owner Program card, as of May 2012.

The Williams Preferred Owner Program is a customer loyalty program. Owners may earn points used as dollars off future service, labor, parts and accessory purchases. You may also earn $250 in sales points when you purchase or lease a new or pre-owned vehicle at Williams. These sales points may be used toward future vehicle purchases.*

Williams is the sponsor of this program. All points earned may only be used at the Williams location in Traverse City, Michigan.
Participation in and eligibility for the Williams Preferred Owner Program
 
All customers with an e-mail address (required to participate), who are age 18 or over who have purchased a vehicle, had service (labor and/or parts) performed on their vehicles, bought accessories and/or parts from Williams are eligible to join this program.**

GM employees are eligible to participate in the service and Points Plus portions of this program.*

Williams employees and their family members are eligible to participate only in the Points Plus shopping portion of this program.

Fleet customers or wholesale customers are not eligible to participate in this program.

Sales and service consultants may offer the Williams Preferred Owner program invitation to interested customers in person, by telephone, or via an e-mailed or mailed invitation.

Each Williams Preferred Owner’s participation in this program indicates their full and unconditional agreement to these terms and conditions.

The personal information that is collected from each customer in connection with the program will be used in accordance with the GM Privacy Policy.

*Beginning May 2012, if you purchase a new or pre-owned vehicle from us, we will add $250 to the available sales points on your card. This amount may be used on your future purchase or lease of a new or pre-owned vehicle from Williams. However, purchasers/lessees using a GM employee related discount (GMS, GM Supplier, GM Dealer) are not eligible to use the $250 in sales points towards future purchases. General Motors prohibits additional dealer discounts on these transactions.

Earning Preferred Owner Program Points

Upon enrollment in this program, the customer will receive three Williams Preferred Owner key chain cards (all with the same number). The card is to be used for each eligible transaction for the person who is registered for the card.

If a family member wishes to use the same card, that person should understand that the credits and/or points will be added to the registered card holder whose card is swiped at the cashier’s desk at the time of the transaction. Points are non-transferable.

Earn points for the Williams Preferred Owner Program in the following ways:

Vehicle purchases on and after May 2012 earn $250 in sales points toward a future vehicle purchase. Limit one card per transaction; cardholder points may not be combined.*

Referring a new sales customer on and after May 2012 to Williams who then takes delivery of a new or pre-owned vehicle earns $50 in service points. The referral cannot be a current or prospective Williams customer.

Each service event on and after May 2012 (parts and labor) earns 5% of total dollars spent (less tax) towards a future service, parts or accessory sale.**

Each parts and/or accessory purchase on and after May 2012 earns 5% of total dollars spent (less tax) towards a future service, parts or accessory sale.**Deductibles from service contract work and body shop work are eligible.

Please Note: Coupons and other special offers may not be used in conjunction with the Preferred Owner program. These dollars spent will not receive the 5% earned reward.

Please note: Warranty and/or service contract work and body shop work are not eligible to earn service points.

Using Williams Preferred Owner Program Points

Preferred Owners may use their earned sales points for any vehicle purchase (new or pre-owned)*, or their service points on service (parts and labor) expense, parts and/or accessory purchases up to a maximum of $300.00 in any one transaction. Read Frequently Asked Questions about Points Plus.

Limit one Williams Preferred Owner card per eligible transaction.

Points have no cash value.

Points are non-transferable.

Points may only be used at the Williams Traverse City location.

Any returned items purchased with points will not be exchanged for cash. The returned item(s) point value will be returned to the Preferred Owner’s account.

Changes and Termination of the Williams Preferred Owner Program

Williams may modify any of the terms and conditions governing this program – including, but not limited to, the ways through which points can be earned, how the program may be used, the value of the earned points, at any time, without notice, even though these changes may affect the Preferred Owner’s ability to use the points that have already been earned.

This program has no pre-determined termination date and may continue until such time that Williams may end the program at any time, with no notice given.

The Preferred Owner’s continued participation in this program constitutes the Preferred Owners acceptance of any changes made to these terms and conditions. The Preferred Owners are responsible for remaining knowledgeable as to any changes that Williams may make to these terms and conditions. The most current version will be available on the Williams Preferred Owner Program section of the website at www.williamstc.com or www.Williamschevydeals.com and will supersede all previous versions of the terms and conditions.
General Terms and Conditions

Accrued Preferred Owner points do not constitute property of a Preferred Owner and have no value outside of the program. Preferred Owners points are credits that Williams may revoke at any time as set forth herein. Preferred Owner Program points may not be exchanged for cash, assigned, bartered, or transferred, except as set forth herein, and are not transferable upon death, as part of a domestic relations matter, or otherwise by operation of law.

Each Preferred Owner is responsible for ensuring that the information in his/her account is accurate and kept current. You may view this information by logging into your account and viewing the Profile tab. Please contact Williams if changes should be made.
Limitation of Liability

By participating in the program, each Preferred Owner accepts all responsibility for, and hereby indemnifies and holds harmless WiIlliams and each of the their related companies, General Motors, Maritz , FMR and each such company’s respective officers, directors, employees, shareholders, agents, and successors, and assigns (the “Released Parties”), from and against any claims that may arise from actions taken by such member or for any unauthorized access to Preferred Owner’s account from a third party.

Under no circumstances, including, but not limited to, negligence, shall the released parties named above be liable for any direct, indirect, incidental, special or consequential damages arising out of the program even if any or all of the released parties have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages therefore such exclusions may not apply to you. If a Preferred Owner proves that Williams has improperly denied that Preferred Owner earned points, liability will be limited to the equivalent amount of earned points. By participating in the program, a Preferred Owner waives any and all right to bring any claim or action related to such matters in any forum beyond one (1) year after the first occurrence of the kind of act, event, and condition, omission upon which the claim or action is based.
